Tie H-2A wages to state-level wage data. This bill would require the Labor Department to use the Bureau of Labor Statistics' Occupational Employment and Wage Statistics (OEWS) survey to set the adverse effect wage rate for H-2A farmworkers and let the Department of Homeland Security begin petition processing while Labor finishes its certification review.

Changes to farmworker wages and visas

If enacted, the bill would require Labor to use State BLS Occupational Employment and Wage Statistics (OEWS) data to calculate the adverse effect wage rate for H-2A farmworkers. This would change the wage floor employers must pay H-2A workers and, depending on state estimates, would raise or lower pay. The bill would also let the Department of Homeland Security begin processing an H-2A petition while Labor reviews the required certification. That would shorten overall waiting times for employers and H-2A applicants. Both changes would take effect upon enactment.
