New tax credits for school bonds
If enacted, holders of designated school infrastructure bonds would get a tax credit equal to 100% of interest paid on each interest date. The bill would limit the total face amount of designated bonds by a national cap of $10 billion for each calendar year 2027, 2028, and 2029, allocated to States based on prior Title I receipts. The bill would also restore and expand qualified tax‑credit bond authorities, including a $1.4 billion annual limit for revived zone academy bonds starting in 2027, and apply federal labor standards to projects financed with those bonds.
Big federal school facilities fund
If enacted, the bill would authorize $20 billion each year for school facilities for fiscal years 2027 through 2031. States would get money based on prior Title I Part A receipts. The Secretary would reserve 0.5% for outlying areas and 0.5% for Bureau-funded schools. States must provide 10% of their allocation from non-federal sources. FY2027 funds would be distributed quickly (within 30 days) to States that give an assurance. Funds would remain available through fiscal year 2036.
Grants, planning, and reporting rules
If enacted, States would award competitive grants to the highest-need school districts for building, modernization, decarbonization, efficiency, air quality, and broadband. States may use up to 10% of covered funds for digital learning. Grants would prioritize schools with at least 40% free/reduced-price lunch (elementary/middle) or 30% (high school). Districts that get grants would have to file a 10-year facilities master plan within 180 days and follow rules on allowable and prohibited uses. The Department would create an Office of School Infrastructure and a public clearinghouse and require regular State and local reporting and five-year national school condition studies. States may reserve up to 5% for administration and must keep a public facility database updated at least every 3 years.
Construction rules and Buy American
If enacted, projects paid with covered funds would need green building verification (for example LEED or an equal State program) and must meet current model building and energy codes and WaterSense standards. Covered funds would include Title I funds from this Act and funds from school infrastructure or qualified zone academy bonds. The bill would also require U.S.-made iron, steel, and manufactured products (manufactured products must have over 60% U.S. component cost), with narrow waiver rules if U.S. products are unavailable, increase cost by over 25%, or for public interest reasons. The bill would define a net zero energy school as one that produces enough on-site renewable energy to meet its yearly use.
More Impact Aid construction money
If enacted, the bill would authorize $100 million per year for Impact Aid construction for each fiscal year 2027 through 2031. This would increase federal construction funding available to Impact Aid‑eligible school districts.
Pyrrhotite school repair program
If enacted, the Department would run a program to pay the federal share of repairs for schools with pyrrhotite-damaged foundations. The Secretary must publish how States receive money within 180 days. The Secretary must approve or deny State applications within 60 days and send approved allocations to States within 60 days. Grants can pay up to 50% of project costs and can reimburse repairs made in the five years before enactment. States must provide at least 40% of project costs from non-federal sources.
