State deadline and school funding cuts
This bill would give each State that receives ESEA funds until the last day of the fifth full fiscal year after enactment to adopt the required concussion measures. If a State missed that compliance deadline, the Education Secretary could reduce that State's ESEA funds by 5% for the first fiscal year after the deadline. If the State remained noncompliant in a later year, the Secretary could reduce ESEA funds by 10% for the following fiscal year. The Secretary would have to give written notice to the State and to Congress before any reduction, and the bill would say it does not change existing civil or criminal liability.
School concussion safety and return rules
This bill would require each local school district to adopt a concussion safety and management plan. The plan would require training for students, parents, and school staff and keep standard release and treatment forms. Schools would post evidence-based concussion information on campus and on their website. If a concussion is suspected, a designated staff member would remove the student immediately, bar play that day, and require a written release from a qualified health care professional before the student returns; schools would provide gradual academic supports and refer persistent symptoms for IDEA or Section 504 evaluation.
