Summary
Requires a health care provider to be physically present for chemical abortions. This bill would make it a federal offense to provide or attempt to provide a chemical abortion drug without a provider physically examining the patient and being physically present at the location where the abortion is performed.

- Families and patients: People seeking a medication abortion would generally need an in-person exam and in-person care. Patients must receive a catch kit and red bag medical waste plus instructions to bring the kit back to the provider.
- Health care providers: Clinicians who provide chemical abortion drugs without meeting the physical-presence and exam requirements could face up to 5 years in prison, a fine up to $50,000, or both, per occurrence.

Ban on remote chemical abortions
If enacted, the bill would make it a federal crime to provide a chemical abortion in or affecting interstate commerce unless three requirements are met. The provider would have to examine the patient in person and be physically present where the abortion takes place. The provider would also have to give a catch kit and a red bag medical waste container and instructions to return them to the provider. Each violation would be punishable by up to 5 years in prison, a fine up to $50,000, or both, per occurrence. The bill would also define key terms, including "abortion", "chemical abortion drug" (including mifepristone and misoprostol), "catch kit", "red bag medical waste", "fertilization", and "unborn child". The rule would take effect upon enactment.
