Show full summary
  • Resellers would have to follow reasonable procedures to verify accuracy before transmitting consumer-report information. If they accurately relay data obtained from another consumer reporting agency, they would be shielded from liability under the Fair Credit Reporting Act.
  • Consumers would get an extra layer of accuracy checks on data shared about them, which could reduce errors in their consumer reports.
  • The bill uses the Fair Credit Reporting Act's existing definition of "reseller" in section 603 to define who must follow these new duties.

New accuracy rules for credit resellers

This bill would impose new rules on companies that resell consumer credit report data. Before a reseller sends report information to an end user or to another reseller, the reseller would have to follow reasonable procedures. Those procedures would need to assure the "maximum possible accuracy" of information about the person. The bill would also bar reseller liability under the Fair Credit Reporting Act when a reseller accurately passes along information it got from another consumer reporting agency to an end user or another reseller. The bill would define "reseller" by referring to the FCRA's existing section 603. The text sets no effective date or sunset.
