Summary

Speeds up additions and removals on the Commerce Department's Entity List. This bill would force faster votes on who belongs on that list and build in a presumption of license denial for entities added under the new rules.

  • Exporters and applicants: License applications involving an entity added under this rule would face a general presumption of denial for items subject to the Export Administration Regulations.
  • Targeted entities: Any member of the End-User Review Committee could submit a proposal to force a vote. The Committee would generally have to approve or disapprove within 30 days, with a one-time suspension of up to 15 days if the Chair and submitting member agree more information is needed.
  • The Committee and Commerce Department: Each Committee member gets one vote and the Chair may not override votes. The Chair must notify the Assistant Secretary of Commerce for Export Administration of final decisions so the Department can implement changes to the Entity List.

Faster Entity List rules for exporters

If enacted, the bill would let any member of the Commerce Department’s End-User Review Committee ask the full committee to vote on adding, removing, or changing an entity on the Entity List. The Committee would have to vote to approve or disapprove a proposal within 30 days after submission. The Committee chair, with the submitting member’s agreement, could pause that 30-day deadline for up to 15 extra days to gather more information, and the chair could also pause only if all voting members unanimously agree. The Committee could add an entity by majority vote for past, present, or likely future activities contrary to U.S. national security or foreign policy. If an entity is added under this rule, there would be a presumption of denial for export licenses involving that entity unless the members who voted to add it later vote by majority to apply a different licensing policy. The chair must tell the Commerce Assistant Secretary for Export Administration about final Committee decisions so the Entity List can be updated.
