Sponsored By: Representative Rep. Hamadeh, Abraham J. [R-AZ-8]
Introduced
Summary
Natural lifetime injunctions would let federal courts impose permanent no-contact orders on defendants convicted of specified violent or sexual felonies. The bill would require courts to include these lifetime no-contact orders in sentencing when the Government or a victim asks.
Show full summary
- Victims and families: Victims can ask a court to bar any contact with the defendant for the defendant's lifetime at no charge. Violating the order is punishable as contempt of court.
- Defendants: Courts must enter the order as part of a sentence on motion by the Government or a victim. The order can be ended only if the victim alleges a pardon or commutation or the defendant shows the conviction was dismissed or overturned on appeal, and the court must hold a hearing.
- Courts and enforcement: "Contact" is defined broadly to include direct or indirect communication, physical interaction, and written, oral, electronic, digital, or automated means. The bill clarifies that federal orders do not limit the application of similar state orders.

Lifetime no-contact orders for victims
If enacted, the bill would require federal courts to include a lifetime no-contact order when a defendant is convicted of a covered offense, if the Government or a victim asks. The order would bar any direct or indirect communication or physical interaction for the life of the defendant. "Contact" would include written, oral, electronic, digital, or physical means, including third parties or automated systems. The order could only be ended or paused if a victim files a motion saying the conviction was pardoned or commuted, or if a defendant files a motion saying the conviction was dismissed or overturned on appeal; the court would hold a hearing and may take evidence. Violating the order could be punished as contempt of court, and victims could not be charged a fee for the order. The bill lists many federal sexual and trafficking crimes as covered offenses (for example, 18 U.S.C. 1591; 2241–2245; 2251; 2252).
