Social Security Overpayment Relief Act
Sponsored By: Senator Ruben Gallego
Introduced
Summary
Bars the Social Security Administration from collecting or adjusting benefits to recover overpayments that are 10 or more years old. This bill would prevent the SSA from recouping overpayments under Title II (Social Security) and Title XVI (Supplemental Security Income) that occurred before the 10-year cutoff, stopping both direct collections from recipients and reductions in future payments for those older errors.

Limits SSA recovery of old overpayments
If enacted, this bill would bar the Social Security Administration (SSA) from reducing or taking back Title II or Title XVI payments for any overpayment that occurred 10 or more years before the SSA Commissioner finds the overpayment. It would stop SSA from adjusting future benefit checks or seeking repayment for those old overpayments. The rule applies only when SSA determines that "more than the correct amount" was paid. The bill text does not specify an effective date.
