New safe harbor for health platforms
If enacted, the bill would create a new safe harbor letting web-based health information platforms be paid by providers or suppliers. It would define who is a "consumer" and an "information service provider" for this rule. Platforms could receive payments only if they meet strict rules: no steering based on payment, no representing that they provide medical or diagnostic services, no sharing consumer contact info except with the chosen provider, no arranging rides, and no other payments to Federal health care program beneficiaries beyond convenience. Payments must be set in writing, be fair market value, be for specified services, and platforms must disclose financial ties and use objective, open criteria for provider participation. If enacted, this would take effect upon enactment.
