New export license rules for businesses
If enacted, the bill would require Commerce to do a competitive market review for certain export, reexport, or in‑country transfer licenses. It would apply only to the technology listed in paragraph (1) of section 1758(b)(3). Commerce must consult the International Trade under secretary. The Commerce official would have to certify to the Senate Committee on Banking, Housing, and Urban Affairs and the House Committee on Foreign Affairs that either no other application was filed or competing applications are for different technologies. After a sole license is issued, Commerce would have to approve later applications for the same technology unless a new, unique risk appears that was not present before. This would take effect upon enactment.
