Higher fines for AI impersonation

If enacted, this bill would double the maximum civil forfeiture and the maximum criminal fine for robocall or text violations when the caller or sender uses AI to impersonate an individual or entity with intent to defraud, cause harm, or wrongfully obtain value. The doubling would apply relative to the maximums otherwise authorized under subsection (b)(4) or (e)(5)(A) of this section or subsection (b) of section 503 for forfeitures, and under subsection (e)(5)(B) of this section or section 501 for criminal fines. The enhanced penalties would apply to violations that occur after the date of enactment.

Robocalls and texts must disclose AI

If enacted, this bill would require a person who makes a robocall or sends a text using artificial intelligence to say at the start that AI is being used. The disclosure must occur at the beginning of the call or message. The bill defines robocall to include calls or texts placed using equipment such as automatic dialing systems or using an artificial or prerecorded voice or an artificially generated message. The bill defines text message to include SMS, MMS, and RCS and excludes real-time, two-way voice or video communication and calls/texts that require substantial human intervention.
