Domestic-content requirement for yellow organic pigments. This bill would treat yellow organic pigments used in road, highway, and airport surface markings as construction materials under the Build America, Buy America framework. Coverage is immediate for pigments used in water-based paints and expands to all formulas 2 years after enactment. It would define “produced in the United States” to require that every manufacturing step, including any chemical synthesis that creates a new molecule, occur in the United States. The Director of the Office of Management and Budget would have 90 days to update Made in America guidance to reflect these changes.

On the date of enactment, pigments used in water-based paints would be covered. Two years after enactment, pigments in all formulas for those surface markings would be covered. "Produced in the United States" would require every manufacturing step, including the chemical reaction that makes the pigment, to occur in the U.S. The Director of OMB would have to update Made in America guidance within 90 days. If enacted, this would likely help U.S. pigment makers and raise sourcing or compliance costs for non-U.S. suppliers, contractors, and procuring agencies.
