  • Tribal law enforcement and tribal agencies: Indian Tribes, as defined in section 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5304), would be eligible to receive and possess post-1986 machineguns under the same rules and exemptions that apply to States and their departments.
  • Tax and transport rules: The bill would add Indian Tribes and their departments to federal exemptions for transfer and making taxes in the Internal Revenue Code and to rules governing the transportation, receipt, possession, and importation of firearms and ammunition alongside States.

Gun parity for tribal law enforcement

This bill would let Indian Tribes and their departments be treated like States for moving, shipping, receiving, possessing, and importing guns and ammo. It would add tribes and their agencies to the federal rules that allow transfers and possession of post-1986 machineguns. It would also extend federal transfer and making tax exemptions for firearms to tribes and their departments. The tax and transfer changes would apply to any firearm transferred or made after the date of enactment.
