Any person who knowingly breaks these disclaimer rules is guilty of a Class IV misdemeanor. The penalty applies only to knowing violations.
The law requires most printed and broadcast political ads to say who paid for them. Printed items must show the payer’s name and street address. If the candidate paid for printed items, the item can list a street address or a P.O. box. This printed rule does not apply to people acting on their own with personal money. Radio and TV ads must name the payer on-air. Stations must keep the payer’s street address (or the candidate’s street address or P.O. box) on file for at least six months and give it to anyone who asks. The commission sets size and placement rules. Windshield stickers, yard signs, bumper stickers, campaign buttons, and balloons are exempt, and the commission can exempt other items printed at a candidate’s or committee’s request.
