AN ACT relating to housing; requiring the governing body of each county and city to adopt an ordinance to authorize by-right a multifamily housing development or mixed-use development that includes a residential use on property zoned for commercial use; declaring void certain county or city ordinances; authorizing the State Land Registrar to transfer, under certain circumstances, certain real property owned by the State of Nevada to certain entities without consideration; and providing other matters properly relating thereto.

Easier apartments on commercial-zoned land

Counties and cities must, by March 1, 2026, allow by-right apartments or mixed-use with homes on commercial-zoned land. Local rules can set clear, objective standards to qualify. This does not apply to industrial zones, airport-related land, or the Tahoe Compact area. Starting March 1, 2026, any local rule that conflicts with these state rules is void.

Local tools to build more housing

Local governments can use density bonuses, inclusionary zoning, and minimum-density rules to add homes. Zoning must fit the local master plan and aim to ensure enough housing, including affordable housing. The law does not create direct payments.

State land to Reno nonprofits for housing

Nevada transfers two parcels near the Northern Nevada mental health campus without payment: about 4 acres to Catholic Charities and about 1.3 acres to Reno-Sparks Gospel Mission. Transfers happen only if the Reno Redevelopment Agency makes agreements, completes surveys and legal descriptions, and pays transfer costs. Deeds must limit use to community and social services, including affordable, workforce, or supportive housing and food services. If the rules are broken, the land reverts to the State.

Faster court deadlines on land-use cases

If you challenge a final land-use decision, you must file within 25 days after the notice is filed. Your main brief is due within 40 days. Replies are due in 30 days, and any party can request a hearing within 7 days after the reply period. Briefs must follow Nevada Appellate Rule 28. Courts can extend deadlines for good cause.

Local expense cap waived for this law

Local governments do not have to follow the NRS 354.599 expense cap for costs tied to this housing law. This gives cities and counties more room to pay for planning, reviews, or infrastructure linked to these rules.
