AN ACT relating to physical therapy; enacting and entering into the Physical Therapy Licensure Compact; authorizing the sharing of certain information with the data system created pursuant to the Compact; providing a person practicing as a physical therapist or physical therapist assistant under the Compact with the same legal status as a person practicing as a physical therapist or physical therapist assistant under a license issued by the Nevada Physical Therapy Board; revising certain terminology relating to physical therapists; and providing other matters properly relating thereto.

Easier multi-state practice for PTs

Nevada joins the Physical Therapy Licensure Compact on July 1, 2025. Physical therapists and assistants with an active, unencumbered home-state license can get a compact privilege to work in member states. A compact privilege counts the same as a Nevada license. To qualify, you must have no adverse action in the last 2 years, meet each state’s law test, notify the Commission, and pay any required fees. Remote states can enforce their rules, remove your privilege, and fine you; loss can block privileges until you meet all conditions and time bars. Active-duty service members and spouses may choose their home of record, PCS state, or current residence as their home state.

Interstate PT Compact Commission setup

The law sets up the interstate Physical Therapy Compact Commission. It can make binding rules, hire staff, manage finances, and run the data system. Rulemaking must include public notice and comment; emergency rules must enter normal rulemaking within 90 days. The Commission can fund operations with state assessments, fees, grants, and donations. Commission officials have legal immunity for official acts, except for intentional or willful misconduct. The Commission can enforce the Compact, use mediation, suspend or remove states, and sue in federal court. The Compact becomes fully active once 10 states have enacted it; Nevada’s law applies July 1, 2025, and a state’s withdrawal takes effect 6 months after repeal.

Background checks and data sharing for PTs

Beginning July 1, 2025, PT and PTA applicants must submit biometric information for an FBI criminal background check. Nevada must share license and discipline data with the Compact’s database; investigative records are available only to member states, and expunged data must be removed. The PT Board may share complaint and investigation records with other licensing boards and law enforcement. Public records rules now reference the Compact when deciding what records are public or confidential.

Nevada licensing updates for PTs and PTAs

Starting July 1, 2025, PTs practicing in Nevada must display their Nevada license or proof of Compact authorization where patients can see it. The Board can charge up to $25 to change the name on a license. A physical therapist assistant’s license stays valid while a supervising PT continues to supervise.
