Homeowners can change transfer-on-death designations

A transfer-on-death (TOD) beneficiary does not get ownership until the owner dies. You can cancel or change a TOD by recording a new designation, a revocation, or a deed that clearly revokes the old one. The new document must be acknowledged after the earlier one and recorded in the county where the property is, before death. If more than one owner signed, one owner’s revocation does not affect another owner’s share. For joint tenants or spouses with survivorship property, all living co-owners must revoke for the TOD to end.

Clear steps to clear judgments across counties

After a satisfaction of judgment is entered in the original county, you can file proof in any other county where it is docketed. You may file a certified copy of the satisfaction, a clerk’s certificate under seal, or a satisfaction signed and acknowledged by the owner (or by the owner’s attorney if no assignment is on file). The receiving clerk must enter the satisfaction on that county’s judgment and lien docket. For partial satisfactions or releases of some debtors, the filing must state the amount paid and name the released debtors.

Deposits after wholesaler rescission go to rescinder

If a seller or a third-party assignee sends a written rescission notice under the law, the person holding deposits or option fees may release the money. The holder may pay the seller when the seller rescinds, or the assignee when the assignee rescinds. The holder may do this without liability.

Tax bill required to end decedent ownership

When you apply to end a decedent’s real property interest, you must attach the property tax bill for the year before death or the most recent bill. You must also include a legal description on or with the application. The register of deeds records the tax bill, unless the register and the county real property lister agree to waive recording. This creates a clear paper trail for title and county records.
