New timing and review rules for highways

The law defines a “categorical exclusion” for highway projects using the federal rule, so some projects do not need an EA or EIS. When the Transportation Projects Commission backs a major highway project, construction must start within 6 years after the first July 1 following the commission’s recommendation. Before that, the commission must be told that DOT, or FHWA if federal money is needed, approved a final draft EIS or EA, or a draft categorical exclusion. Any approval report must include a financing plan that, if used, funds all listed projects and the recommended project so work can start within that six‑year window. For certain major projects in s. 84.013(1)(a)2m, DOT may ask to proceed any time after it completes a draft EIS, draft EA, or draft categorical exclusion, but before construction.
