County jails can provide mental health care

Beginning July 1, 2026, the Department of Health can designate county jails to provide security, exams, and treatment for accused people who need competency services. The department can sign contracts with those jails and with counties. A county jail with a written contract counts as a facility under this law. The new section is part of the same rules that already cover competency exams and care.

Funding and oversight for jail care

From July 1, 2026 to June 30, 2028, the law gives $5 million to the Department of Health to carry out this program. The money cannot be used for other purposes, and any leftover money returns on June 30, 2028. The amount drops dollar‑for‑dollar by any money for the same purpose in 2026 budget bills. By October 1, 2027, the department must report which county jails were designated and how contracts were used.

Immunity rules for jail mental health care

Starting July 1, 2026, the usual government liability for injury, death, or property damage does not apply to care given under this jail‑based competency program. The government is also not liable for medical malpractice by government or contract doctors and nurses for this care. People employed by or contracted with these facilities are treated as public employees under the Governmental Claims Act when they provide these services.
