Existing broker contracts stay valid

Beginning July 1, 2026, the law does not change broker or agency contracts made before that date. Any agreements you signed earlier stay in force under their original terms.

Who counts as a real estate customer

Beginning July 1, 2026, the law defines a real estate “customer.” You are a customer if you show interest in buying, selling, or leasing; if you attend a showing without an agency deal; or if you are in a transaction with no agency or intermediary with any licensee. This definition guides which disclosures and duties apply to you.

Written broker disclosures before talks

Beginning July 1, 2026, real estate licensees must give you a written relationship disclosure before talks about buying, selling, or leasing and before any written agreement. Open houses, brief chats, and simple requests for facts do not count as those talks. The disclosure must say you do not have to sign an agency agreement to view homes and that your communications are not confidential. The form must have a receipt signature line; signing it alone does not create a contract. A representation agreement is not valid until you sign the acknowledgment. If you refuse to sign, the licensee may note the refusal and still provide services or continue the deal.
