AN ACT relating to defense forces and affairs; amending eligibility requirements for indigent veterans in order for counties to request reimbursement for preparing and transporting indigent veterans for burial; specifying indigent veterans who qualify for burial expenses paid by the department of family services also qualify for payment of burial expenses by counties; increasing the amount paid for burial expenses by the department of family services; clarifying priority of payment for burial expenses of indigent veterans; making a conforming amendment; and providing for an effective date.

County help for indigent veteran burials

Beginning July 1, 2026, county commissioners must arrange body preparation, transport, and burial for veterans who served in a war (not dishonorably discharged) and die without enough money. County help is capped at $500 for transport and $1,500 for burial. Counties pay last, after all other sources. Counties may ask the state for reimbursement each year by August 1 for the prior fiscal year. If the state makes a burial payment under its program, counties are not responsible for costs above that amount.

More burial help for low-income recipients

Beginning July 1, 2026, the Department of Family Services pays burial or cremation costs for people on POWER, SSI, or Medicaid who die without enough money. The department pays up to $1,500 after using all other available funds. It also pays up to $500 to move a qualifying veteran’s body to a veterans’ cemetery. The department does not count up to $1,500 in a qualifying Medicaid trust when checking eligibility. Cemetery charges are not covered. Payments depend on available department funds.
