For FY2023–FY2026, two‑thirds of certain severance taxes are split evenly: half to the Permanent Wyoming Mineral Trust Fund and half to the Common School Account. In FY2027, up to $105 million of that two‑thirds portion goes to the Wyoming energy dominance fund. Any amount above $105 million is split 50/50 to the trust fund and the school account. Starting in FY2028, that portion is split two‑thirds to the trust fund and one‑third to the school account. These rules take effect July 1, 2026.
Beginning July 1, 2026, the law creates the Wyoming energy dominance fund run by the Energy Authority. It offers grants for Wyoming energy needs, but not wind or solar. Grants require $1 in nonstate cash for each $1 from the fund, and the cash must be secured before award; in‑kind or past spending does not count. It also offers loans with interest at the federal funds rate minus 1 point (not below 0%), at least a 1% origination or guarantee fee, terms up to 10 years, proven full project funding, and adequate collateral; repayments go to the Permanent Wyoming Mineral Trust Fund reserve account. The fund section ends December 31, 2028, and any unspent money then returns to that reserve.
Beginning July 1, 2026, the Energy Authority may use general appropriations only for administration, planning, and research. Program spending must come from the Wyoming energy dominance fund.
Beginning July 1, 2026, the Energy Authority accepts applications at least every four months. You first submit a concept paper, then a full application. There is a public comment period, a legal review by the Attorney General, and the Governor makes the decision. If you receive money, you must report quarterly and submit a final report with a financial audit at your expense. Before spending fund money, the Authority must give 30 days’ notice to key legislative committees, and the management council reviews and votes on recommendations. The fund section ends December 31, 2028.
