Portable benefits for independent contractors

Beginning July 1, 2026, independent contractors can open a portable benefit account run by an approved provider. You can use it to pay for health, dental, vision, life, income‑replacement, or retirement plans. Anyone, including you or a hiring company, can put in money voluntarily. A hiring party can withhold from your pay to fund the account only if you clearly agree in writing and opt in. You may opt out anytime; a hiring party can stop after giving at least 60 days’ notice. Contributions to your account cannot be used to decide whether you are an employee or an independent contractor.

Banks and tech firms can run accounts

Banks, savings and loans, credit unions, investment firms, and tech providers can be approved to run portable benefit accounts. Others may qualify if the state banking commissioner approves how they administer accounts. These rules take effect July 1, 2026.

Rules and start date for accounts

The Department of Workforce Services must write rules to run the portable benefit account program. Section 1, which creates the accounts, takes effect July 1, 2026. Other parts of the law take effect immediately under Wyoming’s process.
