New bankruptcy and closure rules for local hospitals

The law lets trustees of county memorial hospitals file for Chapter 9 bankruptcy or dissolve the hospital. Their vote takes effect only after county commissioners approve the bankruptcy petition and initial debt plan, or the dissolution plan. Trustees may then seek court approval of the plan and close the case, or carry out the dissolution. Hospital districts also can file for Chapter 9 or dissolve. Before any bankruptcy vote by a district, the petition and initial debt plan must be posted on the district’s website for at least seven days before the first public meeting. A district’s bankruptcy filing does not require a vote of qualified electors. The law takes effect immediately.
