Title 10 › Subtitle Subtitle A— - General Military Law › Part PART II— - PERSONNEL › Chapter CHAPTER 57— - DECORATIONS AND AWARDS › § 1129a

Summary

The Secretary in charge must treat an active‑duty service member who was killed or wounded by a foreign terrorist organization the same as a member killed or wounded in an international terrorist attack on the United States for purposes of awarding the Purple Heart. This applies when the member was targeted because they were in the Armed Forces, unless the death or wound was caused by the member’s willful misconduct. An attack counts as by a foreign terrorist organization if the attacker had communicated with that group beforehand and the attack was inspired or motivated by it. "Foreign terrorist organization" means an entity designated under section 219 of the Immigration and Nationality Act (8 U.S.C. 1189).
