Title 10 › Subtitle Subtitle E— - Reserve Components › Part PART II— - PERSONNEL GENERALLY › Chapter CHAPTER 1203— - ENLISTED MEMBERS › § 12107
To join the Army National Guard of the United States or the Air National Guard of the United States, a person must be enlisted in their State Guard, take the oath found in section 304 of title 32, and be in a federally recognized Guard unit at the rank they will hold as a Reserve. The Army and Air Force Secretaries will make rules so that when someone enlists in or extends enlistment in the Army or Air National Guard, they are also enlisted in, or have their Reserve enlistment extended in, the Army Reserve or Air Force Reserve for service in the respective Guard of the United States. If an Army Reserve or Air Force Reserve member joins the Guard in their reserve rank and is in a federally recognized Guard unit, they become a member of the Guard of the United States and stop being a member of the Reserve.
