A person who is eligible for regular retirement under chapter 65, 741, 841, or 941 can choose to get retired pay under this chapter instead, if they meet this chapter’s qualifying rules, served in an active status in the Selected Reserve after they became eligible for the other retirement, and completed at least two years of satisfactory service in that Reserve active status (time on active duty does not count). The Secretary can cut the two-year rule to one year for someone who served at least one year as an adjutant general or assistant adjutant general and left because their appointment was ended as described in 32 U.S.C. 324(b). When the person makes the election, the Secretary must stop their eligibility or pay under the other chapters and, for reserve commissioned officers, move them to the Retired Reserve. The election must be filed in the form and within the time the Secretary requires. If the Secretary gets the election within 180 days after the person reaches the eligibility age under section 12731(f), the election takes effect on that age date. If the Secretary gets it later than 180 days, or if the person retires from active status during that 180-day period, the election takes effect on the first day of the month after the Secretary receives it.
