Certain junior reserve officers who would otherwise be removed from the reserve active-status list under sections 14504, 14505, 14506, or 14507 can be considered to stay on that list under rules made by the Secretary of Defense. This mainly covers first lieutenants (Army, Air Force, Marine Corps) and Navy lieutenant (junior grade) who are health professions officers or who are working toward a bachelor’s degree. Any continuation must fit the service’s needs and follow section 14509. Officers kept on the list have time limits based on rank: captains (Army/Air Force/Marines) or Navy lieutenants — until the last day of the month they hit 20 years of commissioned service; majors or lieutenant commanders — until 24 years; lieutenant colonels or commanders — until 33 years; colonels or Navy captains — until 35 years. If an officer picked to stay says no, they are separated under section 14513 or 14514. If an officer kept on the list is not promoted and is not on a promotion list, they will be separated when their continued period ends under 14513 or 14514. Health professions officers who owe service under section 16201 and would otherwise be removed must be kept on the list until they finish that obligation, unless the Secretary orders otherwise. If such an officer is later promoted or placed on a promotion list, they do not have to leave after finishing the obligation and may remain like others of the same grade. The Secretary of Defense must make rules to run these procedures.
