A member or ex-member can ask, within 15 years, for a five-officer board to reexamine a disability retirement or separation. At least two members must be medical officers from the military or the Public Health Service. The board has the same powers as the original board, reviews service records and other evidence, allows testimony in person or by affidavit, and sends findings to the Secretary, who forwards them to the President. The person who asks may appear alone, with a lawyer, or with an accredited representative of an organization recognized by the Secretary of Veterans Affairs under chapter 59 of title 38.
