Title 10 › Subtitle Subtitle A— - General Military Law › Part PART IV— - SERVICE, SUPPLY, AND PROPERTY › Chapter CHAPTER 169— - MILITARY CONSTRUCTION AND MILITARY FAMILY HOUSING › Subchapter SUBCHAPTER I— - MILITARY CONSTRUCTION › § 2813
The Secretary of the relevant military department can use money set aside for a planned construction project to buy an existing facility (including the land it sits on) near a base instead of building new. The Secretary can do this only if the bought facility meets the needs of the planned project and if buying it is in the best interests of the United States. The Secretary may also fix up or change the facility as needed, but the costs for those changes must stay within the original project’s authorized amount and must be counted when deciding if buying is cheaper and in the nation’s best interest. Before signing a purchase contract, the Secretary must tell the appropriate Congressional committees why they will buy the facility and then wait 14 days after the committees get that electronic notice under section 480.
