If the Secretary of a military department learns of credible negative information about someone a promotion board recommended for a rank at or below major general or rear admiral, and that information was not given to the promotion board, the Secretary must call a special selection review board to recheck the promotion recommendation. The Secretary may instead wait and send the new information to the next regular promotion board. While under review, the officer’s name must be kept off the public promotion list and not sent forward for appointment or nomination. The special review board gets the officer’s original promotion record and the adverse information. The officer must be shown the adverse information and given a fair chance to comment, except when the information is classified (then a suitable summary is used) or the officer already saw and commented on it. The board compares the officer’s record to samples of those recommended and not recommended, keeps the target anonymous, and uses the same standards as the original promotion board. A promotion recommendation is kept only by majority vote and only if the officer ranks in the top half or is judged as qualified as those recommended. If the board does not sustain the recommendation, the officer is treated as not selected. The board must send a written report signed by each member. If the President approves a sustained recommendation, the officer is appointed as soon as practicable with the same rank date, pay start date, and place on the active list as originally would have applied. The Secretary of Defense must issue uniform rules for these reviews, and any extra rules from a military department need the Secretary of Defense’s written approval. promotion board — the normal selection board that reviews and recommends officers for promotion.
