Title 10 › Subtitle Subtitle F— - Alternative Military Personnel Systems › Part PART I— - SPACE FORCE › Chapter CHAPTER 2005— - OFFICERS › Subchapter SUBCHAPTER IV— - FAILURE OF SELECTION FOR PROMOTION AND INVOLUNTARY SEPARATION › § 20251
Apply the rules in sections 14501, 14503, 14504, 631, and 632 to promotions of officers on the Space Force officer list, with a few changes. Whenever those rules mention the reserve active-status list or the active-duty list, treat that as the Space Force officer list. Whenever they refer to a promotion board under section 14201 or 611, treat that as a board under section 20211. The part of section 14501 about officers who are no longer in the normal promotion pool does not apply to Space Force officers. For sections 631 and 632, any rule about qualifying for retirement means qualifying under any law except chapter 61. For counting “failed selections,” do not count a Space Force officer as having failed twice (for purposes of 629(e)(2) or 14501(b)) until the officer has failed promotion the maximum number of times allowed for that grade under section 20234. Likewise, any place that refers to an officer who failed promotion a second time (in 631(a), 632(a), or 14504–14506) instead means an officer who has failed the maximum number of times allowed under section 20234.
