Title 10 › Subtitle Subtitle B— - Army › Part PART IV— - SERVICE, SUPPLY, AND PROCUREMENT › Chapter CHAPTER 764— - ARMAMENTS INDUSTRIAL BASE › § 7554
The Secretary must use contracts, leases, and similar commercial agreements for each eligible facility made available for the ARMS Initiative. The Secretary must decide whether to buy services from the property manager—like maintenance, operation, changes to the facility, environmental cleanup, and disposal of ammunition manufacturing assets—based on efficiency, cost, emergency mobilization needs, and the ARMS Initiative goals. The Secretary may sign contracts and subcontracts for terms up to 25 years and may use the procedures allowed under section 3204(a)(5) of this title when the contractor or subcontractor is a source specified by law. If the contract makes the property accountable, the Secretary may accept payment that is not rent or facility revenue. Acceptable noncash payments include improvements, upkeep, repairs, lower overhead or product costs, and demilitarization and storage of conventional ammunition. The Secretary may do this without regard to section 3302(b) of title 31 or any other law.
