Defines key words used in the subchapter. Eligible low-income housing means housing with a loan or mortgage that falls into certain HUD-insured, assisted, or HUD-held categories listed in the law (for example under 1715l(d)(3), 1715l(d)(5), or 1715z–1), including housing held by the Secretary that used to be in those programs, and that under a rule or contract in effect before February 5, 1988, is or will within 24 months become eligible for prepayment without the Secretary’s prior approval. Federal cost limit means the amount set under section 4105(a). Low-income affordability restrictions means rules or agreements that limit tenant rents, tenant rent payments, or who can qualify by income. Low-income families or persons and very low-income families or persons mean those whose incomes do not exceed the levels set in section 1437a(b)(2). Moderate-income families or persons means those with incomes between 80 percent and 95 percent of the area median, as set by the Secretary with family-size adjustments. Nonprofit organization means a private nonprofit set up under state or local law that does not distribute profits to insiders, meets HUD’s financial accountability standards, and has major activities to provide decent affordable housing for very low-, low-, and moderate-income families. Owner means the current or future owner(s) of eligible low-income housing. Preservation equity means, depending on the program use, the preservation value (as defined under section 4103(b)(1) or (2)) minus either any debt secured by the property or the outstanding balance of the federally-assisted mortgage(s), used to calculate authorized returns, incentives, or acquisition loan amounts under the cited sections. Preservation value means the value determined under section 4103(b). Secretary means the Secretary of Housing and Urban Development. Resident council means an incorporated nonprofit or association that represents the housing residents, holds regular officer elections under written rules, and has a democratically elected board chosen by the residents.
