The Director can send a notice of charges to an enterprise when the enterprise fails to follow certain reporting or housing-plan rules. This covers failing to file a report required under section 4547 after notice and a chance to comment, failing to provide information required under section 1723a(m) or (n) or section 1456(e) or (f), failing to file a housing plan for the housing goals in sections 4562(a) and 4563(a)(1) as required by section 4566(c), or failing to comply with such a housing plan. The notice must say what the enterprise did and set a time and place for a hearing to decide whether a cease-and-desist order should issue. If the Director finds the facts at the hearing (or the enterprise agrees under section 4582(a)(4)), the Director may order the enterprise to file the 4547 report, provide the required information, submit a housing plan under section 4566(c), or comply with that housing plan. The order starts 30 days after it is served, unless a consent order says a different start time, and remains in effect unless stayed, changed, ended, or set aside by the Director or under this subpart.
