The Commandant can mark certain Coast Guard acquisition jobs as shortage jobs and use the hiring powers in 5 U.S.C. 3304 to recruit and appoint qualified people directly. The Commandant must include information about those marked jobs in reports required under section 1102. If a retiree getting an annuity from the Civil Service Retirement and Disability Fund takes one of those marked acquisition jobs, their annuity keeps paying and they are not treated as an employee under subchapter III of chapter 83 or chapter 84 of title 5. A retiree who left under sections 8336(d)(1) or 8414(b)(1)(A) and who returns after the date the Elijah E. Cummings Coast Guard Authorization Act of 2020 became law may choose to be covered instead by section 8344 or 8468. That choice must be filed within 90 days after the Commandant reasonably notifies the person, and coverage starts the first day of the first pay period after the choice is filed. If the person is eligible but misses the deadline, their annuity continues and they are not treated as an employee.
