The Coast Guard must have a Special Advisor to the Commandant for Tribal and Native Hawaiian Affairs. The Secretary and the Commandant pick the Advisor in a competitive search. The Advisor must know Federal Indian law and how to consult with tribes, should know issues that affect Native Hawaiians when possible, and must have a strong record of working with Indian Tribes, Tribal organizations, and Native Hawaiian organizations. The job is a career reserved position at GS–15 or higher. The Advisor must make sure the United States meets its trust duties and talks with Indian Tribes as governments in a timely, meaningful way. The Advisor must also make sure the Coast Guard engages with Native Hawaiian organizations and Tribal organizations, advise the Commandant on Coast Guard policies that affect tribes, help carry out Federal consultation and engagement policies across the Coast Guard, and support tribes and Native Hawaiian groups on Coast Guard matters. No Coast Guard or Department of Homeland Security official may block the Advisor from giving direct, independent advice to the Secretary and the Commandant. The terms “Indian Tribe” and “Tribal organization” follow 25 U.S.C. 5304, and “Native Hawaiian organization” follows 20 U.S.C. 7517 and also includes the Department of Hawaiian Home Lands and the Office of Hawaiian Affairs.
