Homeland Security must pay the Defense Department ahead of time an amount that equals the estimated cost of medical care Defense will provide to Coast Guard members, former members, and their dependents at military hospitals and clinics. This does not cover former members or dependents who are eligible for Medicare or whose care is paid from the Medicare-Eligible Retiree Health Care Fund. The advance payment replaces the later reimbursement called for under section 1085. Money for current members and their families comes from Coast Guard operations funds. Money for former members and their families comes from retired-pay funds. Defense sets the way to figure the amount. Payment is made in the same fiscal year the care is given and can be adjusted afterward if the advance was too high or too low. No payment is made while the Coast Guard is operating as part of the Navy. This rule does not require payment for care provided under any TRICARE program.
