You can sue the United States, its agencies, and people acting for the U.S. with its consent in federal or state court for violations under this chapter, and you can sue a State, state agency, or state official in federal court; neither the U.S. nor a State may use the Eleventh Amendment or other claims of immunity as a defense. The same remedies apply as against any other defendant, including those in sections 1114, 1116–1119, 1120, 1124, and 1125 (for example, injunctions, money damages, profits, costs, attorney’s fees, and destruction of infringing items).
