Low-speed electric bicycles are treated as consumer products and must follow the Consumer Product Safety Commission rules at 16 CFR 1500.18(a)(12) and part 1512. A low-speed electric bicycle is a two- or three-wheeled vehicle with working pedals, an electric motor under 750 watts (1 h.p.), and a top motor-powered speed under 20 mph on a flat surface with a 170-pound rider. The CPSC can make new or changed safety rules for these bikes, and federal rules override any state law that is stricter.
