Title 15 › Chapter CHAPTER 88— - INTERNATIONAL ANTITRUST ENFORCEMENT ASSISTANCE › § 6207
The Attorney General or the Commission may not investigate under section 6202, seek an order under section 6203, or give antitrust evidence to a foreign authority under a mutual‑assistance agreement unless they decide three things: the foreign authority will meet the assurances in section 6211(2)(A), (B), and (E) and keep the evidence confidential; giving the evidence will not violate section 6204; and the action is in the United States' public interest, including whether the foreign state or regional body has a stake. They must not disclose evidence in ways the agreement forbids, except the agreement cannot stop disclosure to a defendant in a U.S. enforcement case if federal law requires it. If they receive the notice in section 6211(2)(H), they must send it to the person who provided the evidence.
