Title 15 › Chapter CHAPTER 14A— - AID TO SMALL BUSINESS › § 640
The President can work with small businesses to set up voluntary agreements and programs that help national defense. If the President approves an agreement and finds a requested action or inaction is in the public interest for national defense, that action won’t be treated as breaking the antitrust laws or the Federal Trade Commission Act. Copies of requests, changes, or withdrawals must go to the Attorney General and the FTC Chair and be published in the Federal Register unless publication would threaten national security. The power to make such requests can only be given to an official who must be appointed by the President with the Senate’s advice and consent. That official must consult the Attorney General and the FTC Chair at least ten days before any request or finding and must get the Attorney General’s approval before making a request. If a request or the Attorney General’s approval is withdrawn, the legal protection ends for later acts based on it.
