Operators can meet the child-protection rules in section 6502 by following self-regulatory guidelines made by marketing or online industry groups or others, if the Commission approves those guidelines. When making the rules, the Commission must encourage self-regulation and allow approved guidelines to count as satisfying the rules after a public notice-and-comment review and a finding that the guidelines meet the requirements. The Commission must decide on safe-harbor requests within 180 days and put its decision in writing. A final decision, or the Commission’s failure to act within 180 days, can be appealed to a U.S. district court under section 706 of title 5.
