A decision approving an Alaska natural gas transportation system only becomes effective if Congress passes a joint resolution during the first 60 calendar days of continuous session that start the day after Congress gets the President’s decision. If Congress does not pass such a resolution in that 60-day period, the President has up to 30 days after that to send a new decision and must explain why. The new decision must be sent while both Houses are in session. If either House already voted down a resolution on the same decision, the President may not resubmit the same decision unless it is materially different. A break in continuous session happens only with an adjournment sine die, and days when either House is out for more than 3 days to a set date do not count toward the 60 days. Each House follows special rules for these resolutions. Resolutions go to the same committee(s). If a committee has not acted in 30 days, someone who supports the resolution can move to force it out of committee; that motion gets limited, one-hour debate and no amendments. Floor debate on the approval is limited to 10 hours (1 hour for certain waiver resolutions), split evenly for and against, with no amendments or reconsideration allowed. The President must include a finding that any environmental impact statement meets the National Environmental Policy Act and must send that statement with the decision. Within 20 days of the President’s transmittal, the Commission must send Congress comments and the Council on Environmental Quality must get public views (if the President’s statement differs from earlier work) and report them; committees must hold hearings on the CEQ report. The President may also ask Congress to waive laws needed for quick construction; such a waiver takes effect only if Congress approves it by joint resolution in the same 60-day window under the same procedures.
