The Secretary must set up a payroll support program and sign agreements with eligible employers to help pay workers. The program has $3,000,000,000 for fiscal year 2021 from the Treasury, available until September 30, 2023. Up to 1 percent of the money can pay for running the program. Agreements can last no more than 6 months. Money can only be used to keep paying wages, salaries, and benefits and to help keep, rehire, or recall workers. Employers cannot use the funds for back pay to returning workers. Employers who got a CARES Act section 2301 credit in the prior calendar quarter, got help under section 9073, or are using a paycheck protection program loan when they apply are not eligible. If overall help falls short, the Secretary must reduce payments pro rata. No new agreements can be signed after the 6‑month window that starts when the first agreement takes effect.
