Enforcement officers may board and search any fishing vessel they have good reason to believe is breaking Article III of the Convention, except where another country controls the fishing area. The officer must carry a special ID in English, Japanese, and Russian and show it to the ship’s master if asked. If the officer still believes a violation happened, they may seize the vessel or arrest people on board. The Secretary of State must tell the vessel’s country as soon as possible. When asked by the Secretary of State, the Secretary or the head of the department that runs the Coast Guard must hand the vessel or person over to that country’s officials as soon as possible, or keep them in U.S. custody if the country cannot take them immediately. If that country asks, the officer must testify at trial or by deposition and provide records or copies needed to prove the offense.
