Title 16 › Chapter CHAPTER 24— - CONSERVATION AND PROTECTION OF NORTH PACIFIC FUR SEALS › Subchapter SUBCHAPTER III— - ENFORCEMENT › § 1172

Last updated Apr 6, 2026|Official source

Summary

The Secretary, the Treasury Secretary, and the head of the department that runs the Coast Guard must work together to enforce the rules in this chapter. They can also name state officers and employees to act as federal enforcement agents for matters under U.S. jurisdiction, but those state people are not federal employees for civil service rules. Federal district judges and magistrate judges can, after a sworn statement showing probable cause, issue warrants and other court orders needed to enforce the chapter. Authorized enforcement agents can carry out those orders, arrest people who break the rules in their presence, search vessels and arrest people aboard when they have reasonable cause, and seize vessels, gear, cargo, and any fur seals taken in violation. Seized or forfeited fur seals will be handled under section 1155 of this title.
