The Secretary may give a council technical help or money only for projects that are in an area plan the council approves. The council must sign a written promise to carry out the project and pay any costs the Secretary does not cover. The Secretary must decide the help is needed and the project must fit the area's comprehensive plan. Any land costs must be paid by the State, local government, Indian tribe, or local nonprofit that will own the land, and that owner must agree to operate and maintain the project. Loans follow terms the Secretary sets but cannot run longer than 30 years after the project is finished. Interest equals the average rate the United States pays on similar-term debt, as set by the Secretary of the Treasury. The area plan must be submitted to and approved by the Secretary before help is given. The Secretary can stop help if it is no longer needed or if progress is too slow.
