The Secretary may buy, accept as a gift, or trade for land inside the park. Lands marked “P04–04” on map number 326–40072E/89/A dated September 1990 can only be accepted as gifts. Lands marked “P04–01”, “P04–02”, and “P04–03” on that map may only be gained by gift, purchase from willing sellers, or trade. The Secretary may trade Federal lands that were left out of the park to get park lands. If those Federal lands are not traded within five years after December 11, 1989, the Secretary may sell them to the highest bidder at not less than their fair market value. All trades or sales must include terms that protect the battlefield setting. Net money from any sale or trade must, subject to future funding, be used to buy park lands. The Secretary may also get or give rights of access and easements to help owners keep access across Federal lands and to provide alternate access across nonpark lands. The Secretary can accept or buy conservation easements on lands next to the park to protect scenic and historic views and keep the area looking undeveloped or historic from inside or outside the park. Inside the area bounded by the Orange Turnpike, the Orange Plank Road, and McLaws Drive, improved property cannot be taken without the owner’s consent unless the Secretary finds the property is being used in ways that harm or threaten to harm the park.
