Summary

The Secretary of the Interior can get land, water, buildings, and other property inside the seashore area by gifts, buying with donated or government money, taking by eminent domain, transfers from other federal agencies, swaps, or other means. Land owned by the State of Texas or its local governments can be acquired only if those owners agree. Federal property in the area can be moved to the Secretary’s control without payment if the agency that holds it agrees. The Secretary can pay the fair market value when buying property and may use an independent appraisal to set the price. He can also trade federal property for private property inside the area. The traded properties should be roughly equal in value, and either side can pay or receive cash to make the values equal.
